In this unpublished decision, the Board of Immigration Appeals (BIA) held that the immigration judge erroneously denied a joint motion to reopen and terminate proceedings to allow the respondent to pursue prosecutorial discretion and adjustment of status. The Board noted that the standards for rescinding an in absentia removal order need not be met in order to pursue a new form of relief, and that any issues of timeliness were cured by the fact that the motion was jointly filed.
