In this unpublished decision, the Board of Immigration Appeals (BIA) reopened proceedings to provide USCIS an opportunity to adjudicate the respondent's Form I-751, Petition to Remove Conditions of Residence. The BIA cited a USCIS memo dated April 3, 2009, that permits the processing of such petitions for noncitizens in pending divorce proceedings. The decision was written by Member Neil Miller.
