This memo from Assistant Attorney General Glenn Perlow to NH Insurance Commissioner Roger Sevigny and Governor's Legal Counsel Michael Delaney provided the legal justification for Governor John Lynch's proposal to transfer $110 million from the Joint Underwriting Association to the General Fund. The memo relied on similar malpractice funds in other states, but failed to include language specific to the New Hampshire compact.
