In this unpublished decision, the Board of Immigration Appeals (BIA) rescinded an in absentia order of removal upon finding the respondent warranted a renewed opportunity to appear before an immigration judge. The respondent had argued that his failure to appear was the result of exceptional circumstances because he was incorrectly advised by a legal services organization that his motion to change venue would be granted and he did not need to appear for his hearing.
