In this unpublished decision, the Board of Immigration Appeals (BIA) remanded the record for further consideration of a joint motion to reopen to allow the respondent to apply for adjustment of status. The immigration judge denied the motion upon finding the respondent was not statutorily eligible to adjust status because he was paroled under INA 236(a), but the Board found the record unclear as to whether respondent was paroled under INA 245(a).
