The Patient Protection and Affordable Care Act (“ACA” or “Act”) includes several key measures that will expand the availability of affordable health coverage. Most relevant here, the ACA authorizes federal tax credits and cost sharing subsidies for insurance purchased through new health insurance Exchanges, which are to be operated by states or, where the state chooses not to do so or fails to do so consistent with federal standards, by the federal government.
