In this unpublished decision, the Board of Immigration Appeals (BIA) rescinded an in absentia removal order upon finding that the respondent's failure to appear was due to exceptional circumstances, including ongoing physical and mental trauma inflicted by the father of her children. The Board apparently found the 180-day deadline was subject to equitable tolling, as the motion was filed years after the in absentia order was entered.
