In an unpublished opinion, the 11th Circuit affirmed the convictions of a Georgia pharmacist charged with 69 counts of health care fraud for claims largely relating to provision of Synagis® (palivizumab) to Georgia Medicaid recipients. The government charged him with submitting claims for larger doses than were actually administered, false diagnostic information to obtain prior authorization, and claims for Synagis more often that it was actually admitted. 11 of the counts dealt with other drugs, including treatments for Hepatitis C and for Nutropin AQ®.
